Rights and Responsibilities

This workshop is a complete rebuild of the Powers and Duties workshop. The instructors are former and current highway officials. 

Who Should Attend

Local highway and public works officials who have or are interested in the legal responsibilities of the operations and management of highway departments in New York State. Deputies, board members, and other anyone with an interest in improving your knowledge of legal issues related to highways are encouraged to attend.

 Participants taking this course will be able to:

  • Discuss a highway official’s authority to prevent or limit legal risks
  • Employ the legal principles that govern the establishment and abandonment of highways
  • Evaluate roads by use and streets by prescription 
  • Explain the legal principles governing the width of a highway right-of-way
  • Guide working relationships between the highway official and board
  • Differentiate between written, actual, and constructive notice
  • Apply other legal rights and responsibilities such as use of emergency powers, conflicts of interest, procurement processes, and labor relations

    • Workshops typically run from 8:30am - 3:00pm and lunch will be served.

Instructors

Marty Roberts retired as the long-term HWY Super for the Town of Reading at the end of 2015. He is also a past President of the New York State Association of Town Superintendents of Highways.

Michal Nowak is the Superintendent of Public Works and Engineering with the Village of Rye Brook. He is the past President of the New York Metro American Public Works Association, past President of the Westchester County Association of Municipal Public Works Administrators, and an International Society of Arboriculture Certified Arborists.
